Terms and Conditions
Please read the following carefully. Your use of the Batcatalog.com web site
("Batcatalog.com") and purchase of the products or services ("Products")
on it means that you agree to these terms and conditions ("Terms").
Shopping with Batcatalog.com
You can order Products in the following ways:
When you place an Order for a Product in any of the ways described above ("Order")
you are offering to buy it for the price stated, subject to these Terms.
When you place your Order online we will send you an email to confirm that
we have received it. This email confirmation is produced automatically so that
you have confirmation of your Order details. The fact that you receive an automatic
confirmation does not necessarily mean that we will be able to fulfill your
Order.
Batcatalog.com may cancel any sale and not supply Products if it is reasonable
to do so and may change or discontinue the availability of Products at any
time at its sole discretion. If an Order is cancelled, any payment made for
the Products will be refunded in full. This does not affect your statutory
rights. All new Orders are deemed separate and each is treated individually.
Price
The price for each Product is shown on Batcatalog.com and excludes your relevant
state tax until checkout. Prices on Batcatalog.com should be accurate but errors
may occur. If we discover an error in pricing of the Products in your Order
we will inform you as soon as possible using the contact details you supply
to us. We will then give you the option of reconfirming your Order at the correct
price or cancelling it. (If we are unable to reach you we will treat the Order
as cancelled). If an Order is cancelled, any payment made for the Products
will be refunded in full.
You will be notified of the delivery costs automatically before you submit
your credit card details, based on the delivery address you specify and delivery
carrier chosen. Prices are quoted on Batcatalog.com in US Dollars - outside
the USA your credit card company should exchange the amount charged to the
currency of your country at the current rate but you may use the Batcatalog.com "currency
converter" to estimate the price in your currency. Please note that the "currency
converter" is only a guide and may not accurately reflect current exchange
rates. Please note that both charges and refunds are in US dollars and Batcatalog.com
cannot be held responsible for any loss due to exchange rate fluctuations.
Customers outside the USA are responsible for import duty/tax in their respective
countries. Unfortunately we cannot advise you what these costs will be - please
consult your local customs office for more information.
Payment
You must pay for your Order before it is delivered. In the USA, you may
pay by credit card, Paypal™, check, or money order. If paying
by check or money order, please list the payee as Bat Conservation International,
Inc. Please also send a cover letter with your full name, delivery address,
telephone number where we may contact you, and the details of your Order.
If your delivery address is outside the USA and you order online, you must
pay by Paypal™. If you wish to pay by credit card, please telephone
us with that information along with your Order. If you are mailing a
payment for an Order, all checks or money orders must be in US Dollars drawn
on a US bank.
Credit Card
Orders may be processed online, by telephone, or by fax using a credit card
(currently VISA, MasterCard, and Discover). Funds should be debited from your
account within one working day after BCI receives your Order. To ensure that
shopping online is secure, your credit card details will be encrypted to minimize
the possibility of someone being able to read them as they are sent over the
Internet.
Your credit card company may also perform security checks to confirm it is
you making the Order. All Order details and invoices will be sent to the credit
card billing address and not the delivery address where the named recipient
of the Order differs.
Batcatalog.com cannot guarantee that a particular Product will always be available.
If we can't supply a Product, we will notify you as soon as possible after
receiving your Order. If this happens, we will refund you the money you
have paid for it.
Delivery
Batcatalog.com delivers to destinations inside and outside the USA. You will
be notified of the delivery costs automatically before you submit your credit
card details. Delivery outside the USA may be subject to local import taxes,
which are your responsibility where they apply. If so, the shipping company
should contact you by telephone once your Products are in customs to let you
know the charge due or else you should consult your local customs office. Unfortunately
we cannot advise you what these charges will be and Batcatalog.com is not responsible
for them.
Batcatalog.com should deliver Products to destinations in the USA within 7
business days in most circumstances. Orders are shipped either by UPS™,
Fed Ex™, or USPS™.
We will make every effort to deliver within the time stated on Batcatalog.com
but we will not be liable for any loss caused to you by late delivery. Please
order from Batcatalog.com with enough lead-time to prevent any loss or disappointment
resulting from the delivery time as Batcatalog.com cannot be responsible for
this. This does not affect your statutory rights as a consumer.
Copyright and Trade Marks
Batcatalog.com does not give you any right or interest in any copyright or
intellectual property rights in any Product nor the right to copy them. The
copyright in Batcatalog.com and the content of all the software, web site and
pages relating to the Batcatalog.com web site is owned by, or licensed to Bat
Conservation International, Inc., unless otherwise specified and may not be
used, copied or altered without our express consent. Copyright extends to the
design, look and feel of Batcatalog.com, all photographs on it and its marketing
materials. You may use Batcatalog.com for private and personal non-commercial
use only - i.e. to view, copy and print portions of Batcatalog.com for the
sole purpose of placing Orders. The materials on Batcatalog.com may not be
used for any other purpose. Batcatalog.com and our logos are trade names or
trade marks of Bat Conservation International, Inc., and may not be used by
anyone else without our express permission.
Privacy and Data Policy
Batcatalog.com makes a commitment to protecting your privacy. When you place
an Order, we may ask you for certain information and you may submit personal
data to Batcatalog.com (for example your name, phone number, postal address,
email address, contact and credit card details). We may also record which products
you are interested in and which products you purchase as well as customer traffic
patterns and site use. This information will be kept securely, and used for
internal administration use such as:
By making an Order and submitting your data you agree to this use. We will
never collect sensitive information about you without your explicit consent.
Marketing Communications
If you have used or ordered Products from the Batcatalog.com web site before,
it is possible that we have this information already and it is being used to
contact you about offers, events, items or related activities that you may
find useful. If you are an existing customer we will continue to keep you informed
unless you tell us not to.
We do not sell, trade or rent your personal information to other companies.
Refunds
We believe that you will be delighted with your product but there may be occasions
where you feel it necessary to return an item. We will process your return
as soon as practically possible, but following the instructions below should
expedite this process. These Terms do not affect your statutory rights.
Unwanted Products
Our policy is to insure that you are satisfied every time you place an Order
with Batcatalog.com. If you are unhappy with an item when you receive it, or
if you simply change your mind, please return it unused and complete with original
packaging and all components, along with the packing slip, for a full refund
less shipping and handling within 30 working days of when you received it. Once
we have inspected the returned item and are satisfied that it has been returned
to us in the same condition it was when delivered to you, we will issue the
refund within 30 days or earlier directly to the credit card used to place
the original order. You will only have to pay for the return mail cost of the
Products.
Faulty Products
We try to fulfill your Order and package the Products properly to insure they
arrive in good condition. However, if a Product arrives damaged, with defects,
or is not what you ordered, we will replace it free of charge or provide a
full refund including shipping and handling as appropriate. Please contact
us within 30 days of receipt and we will arrange a refund or replacement. In
these circumstances, we will also reimburse you the cost of the return postage
if we require you to return the Product to us. In those cases, please obtain
a receipt from the carrier/facility where you mailed the package to enable
us to process the refund for your return postage costs. This does not affect
your legal rights.

Batcatalog.com Responsibilities
Batcatalog.com will provide its services with reasonable care but does not
give any guarantees, warranties or representations in respect of any other
person's services. Because of the nature of the internet, Bat Conservation
International, Inc. provides and maintains Batcatalog.com on an "as is,
as available" basis and makes no promise that use of Batcatalog.com will
be uninterrupted or entirely error free. We are not responsible to you if we
are unable to provide our Internet services for any reason beyond our control.
Except as provided above, we can give no other warranties, conditions or other
terms, express or implied, statutory or otherwise, and all such terms are hereby
excluded to the maximum extent permitted by law.
Subject as aforesaid, to the maximum extent permitted by law, Batcatalog.com
excludes liability for any loss or damage of any kind howsoever arising, including
without limitation any direct, indirect or consequential loss whether or not
such arises out of any problem you notify to Batcatalog.com and Batcatalog.com
shall have no liability to pay any money by way of compensation, including
without limitation all liability in relation to:
Purchase Orders
We accept Purchase Orders. However, there is a minimum order value of $100. Please call to set up an account.
General
Batcatalog.com may change or withdraw any part of Batcatalog.com, or may refuse
you access to the web site at any time if we consider it necessary. Batcatalog.com
may also terminate this Agreement and immediately remove, cancel or suspend
access to and use of Batcatalog.com upon breach of any part of these Terms
whatsoever. Termination shall be without prejudice to Batcatalog.com's other
rights.
Batcatalog.com acts as principal on its own account and not as agent for you
or any other person. If Batcatalog.com does not enforce any provision of this
agreement such will not be considered a continuing waiver. In the event that
any part of these terms is held to be unenforceable, such part will, at Batcatalog.com's
option, be construed as far as possible to reflect the party’s intentions
and the remainder of the provisions will remain in full force and effect.
These Terms constitute the full agreement between you and Batcatalog.com and
may only be amended in writing. They apply to the exclusion of all other terms
or conditions of contract proposed. We cannot guarantee that Batcatalog.com
complies with local laws of any countries other than the USA.
